Common Estate & Trust Documents

  • Living Trusts Must be notarized to be legally binding. Typically involves an acknowledgment from the grantor to confirm identity and voluntary signing.

  • Durable Power of Attorney (POA) Grants authority to an agent for financial or legal decisions. Most states require notarization for validity.

  • Healthcare Power of Attorney Designates someone to make medical decisions if the principal is incapacitated. Often requires notarization and/or witnesses.

  • Advance Healthcare Directive / Living Will Outlines medical treatment preferences. Notarization helps ensure enforceability with healthcare providers.

  • Real Estate Deeds Common in estate plans involving property transfers into trusts or to heirs. Must be notarized for county recording.

  • Guardianship & Conservatorship Documents Used to appoint guardians for minors or dependents. Notarization strengthens legal standing if challenged.

  • Last Will & Testament Not always required to be notarized, but a self-proving affidavit attached to the will can simplify probate by proving its validity without witness testimony.
